Hiring was slow for many employers in 2009. However, as positive indicators have begun hinting at a recovery in the economy, you may be thinking about hiring again in 2010! Employers planning to hire employees in New York need to be aware of a recent labor law change. This law applies to any employer (excluding governmental agencies) hiring an employee based in New York, regardless of where the employer is based. The provisions of the law are this – newly hired employees must be given a written notice that includes their rate of pay, their overtime rate of pay (if they qualify for overtime pay), and the date (or day) that they will be paid (i.e., every other Friday, the 15th of the month, etc.). The employee must sign this acknowledgement, and the employer must retain the form for six years. Employers are not required to use a specific form issued by the NY Department of Labor. However, it has provided sample forms that employers may either use or edit, which can be found on their website. Then utilize the applicable form under “Leaflets and Flyers” (i.e., the form for an hourly or salaried employee, exempt, piece rate, etc.). The forms can be modified for an employer’s individual use; however, the three basic provisions detailed above must be retained in the form.
